This is for the general information of all concerned that the 48th Meeting of Construction Development Board held on the 3rd March 2008 has suspended the CDB registration of Bhutan Engineering Company Pvt. Ltd. (BECPL) for a period 6 months with effect from the 25th March 2008 till 24th September 2008 in connection with offences committed by the firm during the execution of “Widening of Doebum Lam”.  However, in order not to interrupt the ongoing contracts which otherwise would affect the Government’s planned activities, the Firm is permitted to complete and handover the ongoing works. 

Therefore, all the agencies concerned are requested to note the above decision of the 48th Meeting of CDB taken in line with the provision of the CDB Manual 2001.

NOTIFICATION

14 JANUARY 2008
As resolved during the 2nd Annual Engineering Conference, the Excellence Award shall be awarded every year during the Annual Engineering Conference to any one construction project that demonstrates excellence in the field of construction quality, timely completion, technical and financial capacity, management and other positive qualities, irrespective of its class and category.  The Annual Engineering Conference decided to institute the Construction Excellence Award every year in order to improve the quality of construction and enhance the image of those involved in the construction industry.

Therefore, procuring agencies are requested to kindly nominate those eligible projects completed in last five years that fulfill the above requirements for further assessment and scrutiny by the selection committee. The best project selected, shall be awarded the 2008 Construction Excellence Award during the 5th Annual Engineering conference after physical verification and cross examination of CDB records of performance assessment.  Nomination forms and selection criteria can be downloaded from CDB website www.cdb.gov.bt/publications.htm or can be obtained from the CDB Secretariat. Nominations, if any, should reach the CDB secretariat latest by 15th February 2008.

This is for information of all concerned that the Dzongkhag Courts of Zhemgang and Mongar had issued its final verdict on the 9th August 2007 and July 2007 respectively, as follows

  1. M/s. Nawang Builders (B), of Mr. Nawang Dorji has been sentenced to 6 months imprisonment and suspension of Construction License for one year (w.e.f 16th May 2007) – for fronting;
  2. Mr. Tshering Dorji, Proprietor M/s. Asiatic T&W Construction (C) ahs been sentenced to 2 years & 11 months – for tempering, forging of initials.
  3. M/s. Gayjur Construction of Minjur Dorji, Class C was sentenced to three years and one month compulsory imprisonment.

CIRCULAR  

October 4, 2007.

The 47th Meeting of the Construction Development Board, in its continued effort to streamline the procurement system and curb fronting/collusion in the construction industry, has approved the following rules/criteria with regard to formation of Joint Venture (JV) among national contractors for procurement of works (RGoB Procurement only):

1.      Formation of Joint Venture (JV) shall be allowed only among construction firms/contractors registered with CDB in the same class. 

2.      Construction firms/contractors shall be deemed eligible to form joint venture for bidding for any contract subject to conditions in terms of number of works permitted to be undertaken simultaneously.  Subject to meeting the bid capacity, Contractor shall be allowed to undertake contract not more than the maximum ceiling prescribed by the CDB, irrespective of whether the contract is executed by the firm independently or on JV basis.

3.      For a joint venture to qualify, each of its partners shall meet at least 25 percent of minimum criteria as individual bidder while the lead partner shall meet at least 40 percent. However, either partner can use full turnover from the joint venture contracts for future biddings.

4.      The resources/figures (turnover, liquid asset, manpower, equipment etc.) for each of the partners of a joint venture shall be taken into account/added to determine the Bidder’s fulfillment of qualifying criteria.

5.      The prime contractor or the lead partner must have CDB registration for that particular category of work specified in the tender.

6.      A firm/contractor that has one of its ongoing projects completed up to 90% can participate in tendering for new work beyond the maximum allowable number of works it is permitted to undertake simultaneously.  In such a case, supporting documents such as payment certificates, letter from procuring agencies etc. should be submitted along with the bidding document to prove completion of 90% or more. 

7.      Award of work under circumstances such as above require that the balance 10% work is completed satisfactorily prior to new award.  This is to ensure that contractors do not execute work simultaneously beyond the prescribed ceiling at any given point of time.

Therefore, all the procuring agencies and construction firms/contractors concerned are hereby requested to note the above for strict compliance during the procurement of works with immediate effect.

NOTIFICATION  

2nd July 2007
This is for general information of all concerned that, in light of the practical difficulties associated to check or assess the present maximum financial ceiling on allowable contract range for class B and C category of contractors, the Construction Development Board, during its 46th. Board Meeting has decided to increase the financial ceiling to three times the existing ceiling as the upper limit for above categories of contractors. Therefore, class B and C contractors can now continue to bid for three number of works simultaneously, with maximum financial ceiling not exceeding Nu.45million and Nu.22.5 million, respectively.

Procuring agencies and construction firms registered under category B and C are therefore, requested to note the  above, which comes into immediate effect.

NOTIFICATION

This is for information of all concerned that the Construction Development Board during its 46th Board Meeting decided that Class C Construction Firms registered in W4 Category henceforth will no longer need to recruit electrical engineers (Diploma) otherwise required as mandatory requirement. However, they would be required to recruit engineers for the purpose of tendering and execution of works based on the requirement of the Procuring Agencies. This decision is made in consideration of the limited number of works under W4 Category and acute shortage of electrical engineers.

 

Therefore, all Class C contractors are requested to note the above change which comes into effect immediately

M/s Asiatic T.W Construction (CDB Registration No. 2285, Class C) and M/s Nawang Builders (CDB Registration No. 2374, Class B) have reportedly been involved in a procurement related dispute.  Therefore, all concerned are requested not to entertain their participation in any tendering of works.  The suspension of CDB Registration of above firms shall come into effect with immediate effect until court verdict is passed.

      This is for the general information of all concerned that M/s Yangki Tobjur Construction bearing CDB registration No. 3741, class petty is cancelled with immediate effect for misrepresentation of facts and non compliance with relevant regulations during the procurement of Construction of Patrol Road Drain at Pasakha Industrial State.

In order to enhance professionalism and to provide the Procuring Agencies with a means of identifying consultant's technical ability to perform the required services, all consultancy firms engaged in construction related activities shall be registered with the CDB as announced in the media during Jan-Feb 2007. Consultancy services for works shall be invited only from CDB registered Consultants/Consultancy Firms with effect from 1st July 2007. Therefore,all the Procuring Agencies concerned are requested to kindly ensure possession of a valid CDB Certificate during the procurement of Consultancy Services.

o encourage professionalism and to protect the interests of the client, the Construction Development Board (CDB) shall henceforth register all consultancy firms related to construction industry who wish to provide professional services in Bhutan.

All consultancy firms related to construction Industries who wish to compete for government or corporate contracts in Bhutan are required to register immediately with CDB.

The non-registered firms shall no longer be recognized by any of the Government and corporate agencies from July 2007 for purpose of offering of consultancy services related to construction industry in the country.

ANNOUNCEMENT

MoWHS/CDB-3/2006-07/271                                                                                       10 November 2006

1.   This is for information of all contractors/construction firms whose CDB registration validity expires on 31 December 2006 that renewal must be processed with the Secretariat at least one month prior to its expiry date.  It may kindly be noted that the practice of issuing Provisional Certificate to contractors who fulfilled the renewal criteria substantially has since been stopped based on the decision of the 45th Meeting of CDB.  Therefore, in order to avoid any impediments in the business due to delay in renewal or due to non fulfillment of renewal criteria vis-ΰ-vis incomplete documents, the Secretariat would like to urge submission of applications with complete documents well ahead of time. 

2.    This is to inform all concerned that the Secretariat shall suspend issuance of New CDB registration/certificate from 1st December 2006 till end of February 2007. This is to enable timely renewal of the mass CDB certificates that expire as on 31st December 2006 and to avoid any inconveniences and delays to new applicants in the process.

This is for information of all concerned that the Construction Development Board during its 45th Board Meeting resolved that Class A and B construction firms henceforth will no longer need to submit documentations on track records along with revalidation applications.  It was decided that all such information required to assess fulfillment of criteria on track records would be checked using CDB database information.  This calls for timely submission of Bidding Reports and Contract Completion Reports by the procuring agencies concerned and submission of copies of Work Order and such other documents to prove activeness of a firm/participation in tenders by the contractors well ahead of time to enable the Secretariat to update its database. 

Therefore, all Class A and B contractors are requested to note the above change which comes into effect immediately.  They must ensure that the above reports in particular the Bidding Report Forms duly filled in are submitted by the procuring agencies soon after the work is awarded, to the CDB Secretariat. In order to avoid any undue delays during revalidation of CDB certificate due in December, construction firms may also submit the reports directly to the Secretariat after obtaining such reports from the procuring agencies concerned.

NOTIFICATION

In super session to our Notification # MoWHS/CDB-03/kg/05-06/1589 published in the June 11, 2006 issue of Bhutan Times, all concerned are requested to kindly note that Construction Development Board (CDB) shall be the authority to review complaints against procurement decisions made by the procuring agencies.  The following procedure shall be followed henceforth:

 

 1.      Procuring agencies shall declare the evaluation result 3 (three) working days prior to issue of letter of acceptance to the successful bidder, so as to give opportunity to unsuccessful bidders who wish to represent any grievances.

2.      In the event of submission of any grievances within three days after declaration of results the issue of letter of acceptance shall be withheld till the matter is resolved.

3.      Grievances if any shall be submitted to the procuring agencies concerned first for redress.

4.      If in the opinion of contractor, clarification provided by the procuring agency is not satisfactory or the procuring agency has not responded to the appellant within 7 (seven) days, CDB shall be appealed with full justification of the contention in pursuance to the rules and regulations in force.

5.      The CDB Secretariat shall then review, verify, investigate the matter as necessary and convey its findings/decisions for compliance upon approval of the Chairman, CDB.

NOTIFICATION

This is for the information of all the Contractors that although it is mandatory on the part of contractors to maintain a registered office space to run their business, it is noticed that some firms do not comply with this basic requirement of Construction Development Board.  Recent attempts to contact contractors at the address provided in the application forms have been unsuccessful.

 

Therefore, all the contractors / construction firms are reminded to ensure maintaining registered office space (HO) with proper postal address. Change in address of office, if any, should be brought to the notice of the CDB Secretariat soon after the change in order to avoid any unnecessary delays during the revalidation process.

The same also applies when change in other particulars such as key personnel and minimum mandatory equipment corresponding to their class takes place.

 

This notification is issued for strict compliance by contractors based on the decision of the 44th Meeting of Construction Development Board and approval of the Chairman of the Board.

The 44th Meeting of the Construction Development Board, in its continued effort to curb fronting and collusion in the construction industry, has decided to limit the number of works that Class ‘A’ contractor(s) can undertake at a time to ‘five’ different contracts subject to meeting the Bid Capacity Criteria. 

All the agencies and construction firms concerned are hereby requested to note the upper limit of five in the number of works for Class ‘A’, and comply strictly in the procurement of works with immediate effect.
